OPINION: What does it take to get a conviction in a rape trial, these days?

I’m genuinely interested to know.

In Hawke’s Bay two men, Jason Trembath and Joshua Pauling, were found not guilty of rape. The woman said she did not consent to sex with them. She was so drunk that she has little memory of that night, and was only aware she was the victim of a sexual assault three months later, when police showed her a photograph that had been posted to a local cricket club’s closed Facebook page.

The photograph showed Pauling sitting on top of her and performing a sexual act, while making a “Hang 10” hand sign. She did not recall the act, or the photo being taken. She says she was comatose. They say she was a “willing participant.” When police showed it to her, she began shaking uncontrollably and was not able to give evidence to the detectives till the next day.
